Mediation / Alternative Dispute Resolution

Mediation / Alternative Dispute Resolution

Litigation is not always the most appropriate way to resolve a dispute.

A mediation is a structured process in which a mediator assists the parties to resolve a dispute. A mediator is an independent and impartial professional who assists the parties to identify and assess options and negotiate an agreement to resolve their dispute.

Mediation can assist parties to resolve disputes in a cost-effective and quick manner. In our experience, mediation is particularly helpful where there is an ongoing business or family relationship that the parties wish to preserve.

Disputes which may benefit from mediation include:

  • Commercial disputes;
  • Employment disputes;
  • Family law disputes (including financial matters and arrangements for children);
  • Disputes involving Incorporated Associations and members;
  • Lease disputes (residential tenancy disputes and retail lease disputes);
  • Partnership disputes; and
  • Wills and estates, including testator family maintenance claims.

Our mediators are John Sullivan and James Sullivan. John has more than 40 years experience as a legal practitioner and significant experience working to resolve business, employment and family law disputes.

James is a legal practitioner and Nationally Accredited Mediator with experience in commercial and general litigation at international firms in London and Melbourne.

We have a conference room and meeting rooms available at our office in Sale. Alternatively we can travel to a venue that is convenient to the parties.

The fees of mediation are generally shared equally between the parties.
